Property Settlement

Dividing property after separation throws up a myriad of questions, problems and uncertainty. There is a vast amount of misinformation, bias and outright folk law out there which is just plain wrong when it comes to how property division works.

We want you to have accurate, reliable advice about property settlement which means you can know where you stand, understand what you are entitled to and why, then make informed decisions so that you get a fair outcome. Lacking reliable advice can mean you agree to something which is not fair and you will regret later.

Get a fair outcome by getting proper legal advice from a lawyer experienced in property settlement, both in negotiations and court proceedings.

Let us finish the paperwork once you have an agreement.

Know where you stand

Sometimes the first thing a client says is "What am I entitled to?" and "I just want a fair outcome"

The first we do is set out for you what really happens when the Court determines the property pool and what each party is likely to receive from the property division. This enables clients to meaningfully negotiate a fair property division, or we can help client negotiate the division of property for you if that's what you need.

We can guide you through the mediation process to try and avoid court proceedings. If that doesn't work, we can take you through property settlement litigation.

Property agreements which are legally binding

Like most things, there is paperwork, even when you have an agreement!

If you and your former partner or spouse have an agreement about property division, we can take care of the paperwork for you to make sure that this is recorded in a final and legally binding way.

Both Consent Orders and Financial Agreements (also called Binding Financial Agreements or BFA's) are final and binding, which means no further claims in future from your ex. What you take in settlement is final. The last thing you want is to divide your property, only to have your ex-partner or spouse re-appear and want to argue it all over again.

Let us take care of the paperwork for you and make sure it is done right. We can prepare a Consent Order or Financial Agreement for you which ensures that you have a final and binding property division with your ex partner or spouse and you can be financially separated after your divorce or separation.
